Decovita Disclaimer Policy
Porcelain ceramic tile is subject to standard variances resulting from the manufacturing process. Decovita warranties that the products are within the industry standard variance levels. Colors in print will not appear exact, photos are not to scale.
Decovita-USA INC. warrants that our products will meet or exceed the testing requirements published in our current product catalogs / literature. We also warrant our tile to conform to any specific physical properties stated in our product catalogs / literature and to be free from manufactures defects for a period of one year from date of purchase.
Sample Policy
Product samples may not be an exact match to supplied materials due to variations in batch manufacturing.
A sample product is merely a representation of a product. This means the supplied materials may have slight differences in color, shade, and/or surface appearance.
Installation Warning
INSTALLATION of the materials constitutes ACCEPTANCE of products.
Therefore, all supplied materials must be inspected by the Customer/Buyer/End User/Installer prior to installation to determine if the supplied materials are acceptable (e.g. proper series, color, shade, texture, glaze, surface finish, etc).
If there is any question as to the material’s appropriateness, the material must NOT be installed. If marks or discolorations of any type are found on the surface of a tile, the tile piece must NOT be installed unless the marks or discoloration are first removed to the satisfaction of the Customer/Buyer/End User/Installer. Decovita will not be held liable for replacement costs for tiles installed with such issues.
Returns
A return cannot be accepted without purchase invoice and without manager approval for full box quantities only.
Any orders purchased within 30 days, there will not be restocking fee unless packaging is damaged and not in sellable condition upon manager approval, however after 30 days any returns will be subject to a 30% restocking fee.
After 60 days no returns will be accepted.
Payment made by credit card will go back to the same card used within 7 business days.
The Credit Card Processing fee is 2.9% and the ACH Processing fee is 1%.
Payment made by check or cash will be refunded by corporate refund check within 14 business days to the same company name and address we have on file.
All products return under this warranty require a Return Authorization (RA) Number. Contact Decovita USA Virginia at 571.926.8326 or Decovita USA California at 714.406.1500 for an RA Number and other important details.
Items must be in their original packaging and full box quantities only.
Any special order (customized product, transfer request of product from Turkey, transfer request of product from one Decovita USA warehouse to another Decovita USA warehouse) is out of return policy, so no returns will be accepted!
Purchasing Terms & Conditions
Each shipment of products by the Seller shall be governed by these terms and conditions notwithstanding any other specific Terms & Conditions of our Manufacturers.
Product and Prices
Unless agreed to otherwise, in advance, in writing and signed by an officer of Decovita, all offered prices are F.O.T. Decovita’s facility. All pricing quotes must be documented in writing and issued by Decovita to be valid. Unless otherwise stated, prices quoted are firm for 30 days from the date quoted. Decovita reserves the right to change its prices and the specifications of its products at any time without notice.
Prices do not include state, local, federal or other taxes and duties, and the same will be additionally charged unless a valid tax exemption or re-sale certificate is provided to Decovita prior to shipping.
State and local taxes, when charged, are assessed based on those rates in effect at the Decovita location selling or servicing the Buyer. All state, local, federal or other taxes and duties are the responsibility of the Buyer.
Decovita’s failure to assess or collect adequate taxes at the time of sale does not relieve Buyer of the responsibility for actual tax liabilities. Product pricing is subject to change without prior notice.
Transfer of Title/Risk of Loss
Delivery by Decovita to the initial common carrier shall constitute delivery to the Customer/Buyer. Decovita’s responsibility ceases upon delivery to the common carrier and all goods are shipped at Customer/Buyer’s risk.
Indemnification
Buyer shall at its own expense apply for and obtain any permits and inspections required for the installation and/or use of Decovita’s products. Decovita makes no promise or representation that the products will conform to any federal, state or local laws, ordinances, regulations, codes or standards.
Decovita shall not be responsible for any losses or damages sustained by the Buyer, or any other person, as a result of improper installation or misapplication of Decovita’s products. Buyer shall indemnify and hold harmless Decovita and its agents and employees against any loss, damage, claim, suit, liability, judgment or expense (including, without limitation, attorney’s fees) arising out of, or in connection with, any injury, damage to or loss of any property, or violation of any applicable laws or regulations resulting from, or in connection with, the sale, transportation, installation, use, or repair of Decovita’s products by the Buyer.
MAP Policy
Decovita USA has an established Minimum Advertised Price (MAP) Policy that an Authorized Reseller must follow for the advertising and marketing of Decovita USA products. All Decovita USA Authorized Resellers must agree to the terms and conditions of the following MAP Policy.
Decovita USA’s MAP Policy Guidelines for Decovita Products
All advertised prices must be at or above MAP for all Decovita products. Our Minimum Advertised Price (MAP) Policy states that no Decovita USA product can be advertised at more than 20% off the List Price. Resellers are not required to list prices in advertising. If a price is listed in an advertisement it must be at or above MAP. Other statements such as “call for price” or “call for quote” are acceptable and permitted.
Resellers are also responsible for ensuring their Decovita pricing is at or above MAP on internet search engines. Resellers are free to set the actual resale price of any product as long as it is at or above MAP price given the most recent publication of the price list. Decovita USA’s MAP policy for all Decovita products apply to advertising placements, including but not limited to: print ads (inserts, magazines, newspapers, catalogs, mail order catalogs, etc.), broadcast (radio and TV), direct mail, faxes, internet placement with third parties (banner ads, broadcast emails, destination pages, third-party sites), internet placements on resellers own website, and any flyers, posters or coupons.
From time to time, Decovita USA may permit resellers to advertise MAP Products at prices lower than the MAP price. In such events, Decovita reserves the right to modify or suspend the MAP price with respect to the affected products for a specified period of time by providing advance notice to all resellers of such changes.
Pricing Statements
Decovita USA’s MAP Policy does allow resellers to omit pricing entirely from advertisements and/or advertisement statements such as “Call for Price”, “Call for Quote” or “See Shopping Cart for Price.”
Free Offers Associated with Decovita USA Products
Free shipping and/or handling, 0% sales tax, or free financing promotions do not violate the MAP.
